Механизм изменения объекта преступным воздействием и учет этих особенностей в конструкциях составов преступлений

Аннотация

Отмечается, что суть уголовного закона обусловлена многими обстоятельствами. Немаловажное значение при этом имеет конструкция уголовно-правовых норм. Обращается внимание на процесс создания конкретной конструкции состава преступления, при котором необходимо учитывать особенности структуры объекта уголовно-правовой охраны и механизм его изменения преступным воздействием. Рассматриваются структура объекта уголовно-правовой охраны и механизм изменения его общественно опасным посягательством. На конкретных примерах показана необходимость при создании конструкции состава преступления учитывать особенности структуры объекта уголовно-правовой охраны и механизм его изменения преступным воздействием.
