О подведомственности третейским судам индивидуальных трудовых споров

Аннотация

Исследуется вопрос о возможности разрешения третейскими судами индивидуальных трудовых споров. Анализируются действующее законодательство, научные точки зрения, правоприменительная практика, правовые позиции Конституционного Суда Республики Беларусь. Сделан вывод о том, что третейские суды вправе рассматривать индивидуальные трудовые споры. В связи с этим предлагается внести в законодательство ряд изменений и дополнений, в частности указать в трудовом законодательстве третейские суды среди органов рассмотрения трудовых споров; перечислить категории неарбитрабильных трудовых споров; уточнить регулирование вопросов недействительности третейского соглашения; изменить подходы к регулированию дерогационного эффекта третейского соглашения; усовершенствовать порядок взаимодействия третейской и судебной форм защиты права по вопросам доказывания и доказательств, обеспечения иска, преюдициальности, исполнения третейских решений.
