К вопросу о допустимости применения полиграфа в процессе доказывания по уголовному делу

Аннотация

В процессе доказывания по уголовному делу одним из этапов выступает сбор доказательств, который заключается в их формировании, т. е. в преобразовании непроцессуальной информации в процессуальную. Однако прежде чем придать информации не просто процессуальное, а доказательственное значение, мы должны ее исследовать, придать анализу содержательную составляющую. Поскольку участники уголовного процесса владеют теми или иными сведениями, которые позволяют установить обстоятельства совершенного преступления, при анализе конкретных примеров из судебной практики для нас стало очевидным, что такие участники могут умышленно искажать информацию, преследуя свои интересы. В связи с этим органы уголовного преследования все чаще используют полиграф в установлении правдивости или ложности показаний. Однако не все правоприменители однозначно высказываются о целесообразности применения полиграфа и назначения психофизиологической экспертизы. Имеют место выводы о сомнительности заключения такой экспертизы, что позволяет рассуждать о ее недопустимости в качестве доказательства по уголовному делу.
