Социально-правовые и исторические предпосылки криминализации вмешательства в персональные данные
Аннотация
Проанализированы социально-правовые предпосылки введения уголовной ответственности за вмешательства в персональные данные, а также рассмотрен исторический аспект становления института персональных данных и его охраны. К основным предпосылкам можно отнести бессистемное и неполное правовое регулирование сферы оборота персональных данных, отсутствие конкретных мер ответственности за посягательства на них, опережающее развитие информационно-коммуникационных технологий по сравнению с реагированием законодательных и правоохранительных органов на совершение правонарушений в этой сфере, масштабность незаконного использования персональных данных и др. Отмечено, что введение уголовной ответственности за вмешательства в персональные данные станет важным элементом предупреждения совершения преступлений в этой сфере, а также будет способствовать эффективному исполнению законодательства о персональных данных. Конкретные меры ответственности, включая пределы криминализации, должны устанавливаться в зависимости от причиненного ущерба, в том числе морального вреда конкретному гражданину, субъекту хозяйствования, обществу, национальной безопасности.
