Правовые проблемы обеспечения баланса публичных и частных интересов в сфере природопользования

Аннотация

Анализируются особенности соотношения публичных и частных интересов в сфере природопользования и общие подходы к обеспечению их баланса. Обосновывается важность согласования всего спектра интересов (экономических, экологических, социальных и иных), определения их приоритетности и выражения указанных приоритетов в экологическом (природоресурсном) праве и законодательстве. Делается вывод о целесообразности развития правовых механизмов, в рамках которых поиск баланса интересов обеспечивается не только государством императивно, но и при непосредственном участии иных субъектов природоресурсных отношений.
