К вопросу об институционализации инвестиционного права (общие положения)

Аннотация

Рассматриваются теоретические вопросы правовой институционализации с точки зрения поиска оптимальной и универсальной структуры права и определения в ней места для новых нормативных массивов. При изложении сформированных к настоящему времени теоретических основ правовой институционализации рассмотрено ее соотношение со смежными правовыми категориями. Анализируются различные точки зрения, сформулированные специалистами относительно признаков и критериев формирования института права, которые могут отражать его сущность. Исследуются и обобщаются позиции по вопросу о месте комплексного института в правообразовательном процессе и его формальном закреплении. С одной стороны, есть необходимость интегрировать комплексное институциональное образование в систему права, в ту или иную его отрасль. С другой стороны, возникает проблема, связанная с невозможностью включать комплексный институт, образуемый нормами нескольких отраслей права, в одну из отраслей, поскольку сфера регулятивного действия интегрированных в него норм, исходя из их объективных свойств, не может быть ограничена предметом и методом отдельной отрасли права. Выявляются и систематизируются научные достижения в сфере теории правовой институционализации, определяются направления их интерпретации применительно к инвестиционному праву с точки зрения возможности и обоснованности институционализации комплексных отраслей права.
