Arbitrability of the dis­putes, connected with unfair competition

Abstract

The article is devoted to the approaches of the Republic of Belarus and foreign countries to arbitrability of the disputes connected with unfair competition. The authors analyse both the provisions of treaties and normative legal acts, as well as the materials of judicial practice on this issue. Based on the analysis made they conclude that it is reasonable for the parties of an arbitration agreement to choose as the law applicable to the contract and lex arbitri the law of the state which in prin­ciple allows arbitrability of the mentioned disputes.
