Supporting concepts of the theory of sources of law

Abstract

The object of the research is the system of formal sources of contemporary law, the subject of research is formed by the scientific results obtained by the author earlier, as well as the achievements of Russian and Belarusian scientists in this area. The relevance of the article is due to the lack of basic concepts in the concept of legal source which link into a single system disparate knowledge about individual aspects of the system of formal sources of law. It is proposed to consider the categories of the essence, content and form of law as the basic concepts of the theory of sources of law. As the essence of law is considered the equivalent nature of this type of social regulation, the content of law includes the principles of law, the rule of law, legal provisions, individual and other rules of behaviour. The external form of law is formed by officially established means of expression and consolidation of the law content, and the internal form of law consists of formalised law, legal consciousness and actual legal relations.
