The concept of forming the legal foundations of the Eurasian environmentally safe space
Abstract
Legal approaches of a conceptual nature in relation to the formation of a space of environmental security on the territory of the states that are parties to the Eurasian Economic Union are being explored. Political and other factors influencing this process, as well as general and special (environmental) principles that can form the basis of the concept of an environmentally safe space, are determined. The rationale for introducing the definition of environmentally safe space into the categorical apparatus of the science of environmental law is proposed. It has been proved that the existing legal mechanisms of environmental protection (environmental impact assessment, strategic environmental assessment, environmental review, monitoring, control) serve as a guarantee for ensuring environmental safety in the space of the EAEU, which can be the basis for convergence of legal approaches of the EAEU member states. It is proposed to consider public-private partnership as a condition for achieving the goals of sustainable development within the framework of integration formations. The place of legal regulation of sustainable nature management in the system of measures that make up the content of the legal category «environmentally safe space» and the directions of interaction between the EAEU member states in this area are determined.
