Правовые стимулы и правовые ограничения в механизме правового регулирования осуществления инвестиций

Аннотация

Исследовано инвестиционное законодательство с позиции теории правовых стимулов и правовых ограничений. Правовые стимулы и правовые ограничения в механизме правового регулирования осуществления инвестиций рассматриваются в качестве отраслевой разновидности правовых стимулов и правовых ограничений на базе основных критериев, разработанных общей теорией права и теорией отдельных отраслей права. Определены направления интерпретации данных стимулов и ограничений применительно к инвестиционному праву. Конкретные правовые средства (правовые стимулы и правовые ограничения) воплощаются в юридические нормы, институты, подотрасли, отрасли, благодаря чему наполняются соответствующим (правостимулирующим или правоограничивающим) содержанием. Показано влияние государственной инвестиционной политики на формирование инвестиционного права.
