К вопросу о правовом регулировании карантина и защиты растений в сельском хозяйстве

Аннотация

Анализируется законодательство, регулирующее отношения в области карантина и защиты растений. Дается характеристика состояния правового регулирования с учетом его последних изменений. Подчеркивается тесная взаимосвязь наднационального и национального уровней источников права, направленных на обеспечение фитосанитарной безопасности. Выявлены позитивные и негативные тенденции развития правового регулирования: последовательное правовое обеспечение цифровизации в растениеводстве, игнорирование физических лиц как участников отношений в области карантина и защиты растений, упрощение требований к обращению со средствами защиты растений. Обоснована необходимость дополнить и уточнить соотношение ключевых правовых категорий. Аргументируется вывод о необходимости конкретизации законодательных основ регулирования отношений в области карантина и защиты растений с участием физических лиц.
