Protective task of criminal law in conditions of modern society development

Abstract

The protective task of criminal law is analysed in the context of constitutional reforms and with an emphasis on ensuring the preservation of sovereignty and national identity, the stable functioning of public authorities, establishing an optimal balance of public-private partnerships, and adequately guaranteeing the protection of human rights and legitimate interests in conditions of intensive informatisation of society. The prerequisites for evaluating the systemic and functional effectiveness of the protective function of the current criminal legislation are highlighted. It is proved that the adaptation of scientifc and technological achievements and innovative processes is impossible without the modernisation of the protective task of criminal law. The prospects for clarifying the protective task of the Belarusian criminal law and ways of developing the differentiation of criminal liability for socially dangerous attacks in the conditions of modern society and new legal regulation are outlined. The conclusion about the need for criminal law protection of new directions for the development of an inclusive economy is made.
